“Modern Landfill violated the Clean Water Act 419 times between 2019 and 2023 and should be fined based on whatever economic benefit it received, according to a federal judge’s order.
The landfill, which operators say is nearing capacity, has drawn the ire of neighbors, environmental groups and state regulators for years. Now, federal Judge Jennifer P. Wilson has issued an order laying out possible fines against the facility run by trash conglomerate Republic Services.
Republic itself suggested $570,000 in fines versus the $4.1 million proposed by the Lower Susquehanna Riverkeeper, which filed the lawsuit along with several nearby residents in January 2023.” …
