“Katherine’s PFAS class action is scheduled to return to court on Monday.
The successful class action against the Defence Department over the chemical contaminants still leaking from the Tindal RAAF Base is back in Federal Court.
Defence had agreed to settle three class actions – Katherine, Williamtown and Oakey – before they reached trial this year.
Katherine is to receive $92.5 million as part of the agreement shared among about 2500 property owners including the Katherine Town Council.
Monday’s court date for an interlocutory hearing before Justice Lee in Sydney,
Although Defence has agreed to settle the case, there are still many details to be worked out including the payments to the Katherine property owners.
The split between the compensation and the legal and other court expenses is also still to be considered in full.
Importantly, the settlement does not include any admission of liability by the government, which has been released from any further claims arising for compensation over property losses, mental anguish or nuisance…”
